Marital sex by mutual consent can be considered rape

A British court ruled: a man can be accused of rape, even if sex with the woman was consensual. This decision was taken at the trial, where her husband was accused of sexual abuse of his wife.

High Court in London under the direction of the Lord Chief Justice made a historic decision to declare guilty rape   a man who had sex with his wife, by mutual agreement. Details of the case are unusual. The woman agreed to have sex with her husband only on the condition that he will come out of it until ejaculation. She did not want to become pregnant again and to have another child.

However, in the last seconds before orgasm, the man told his wife that he would not go out of her, because she is his lawful wife, and he "wants so much." This unusually loud incident took place in February 2010. Shortly after having sex with her husband the wife became pregnant. The Lord Chief Justice ruled that, as a man (the husband of a woman under Sharia law) are not fulfilled "an agreement made prior to the sexual act," it should be found guilty of rape .

According to the judge, the woman agreed to have sex in this case is important because its "refusal to come out in time," a man of his brutally trampled. Thus, the judge overturned the decision of the prosecution not to prosecute. In May 2010, a woman called the "hot line" for victims of violence and made a formal statement, but prosecutors, examining the circumstances of the case, the man refused to impose charges.
